WAIVER AND RELEASE OF LIABILITY
In accordance with Title 5, California Code of Registrations section 55450, and applicable law, and in consideration of my / my student’s (”student” here includes a child or other minor on whose behalf I have legal authority to sign this document) participation in said activitie(s), service(s) or field trip(s) (herein referred to as “Services”), I hereby release the Drawwing Cabinet, its officers, employees, directors, and agents from and waive all claims that may be made by me / my student, me / my student’s estate, heirs and assigns, both present and future for any and all injury (both physical and non-physical), accident, illness, death, or property damage occurring during or relating to the above described Services, regardless of cause. Further, I agree to indemnify and hold harmless the Drawwing Cabinet, its directors, employees, and agents from any claims and actions for damage or injury which any person may claim was caused by, or was the result of, my / my student’s conduct while participating in said Services.
COVID-19 ASSUMPTION OF NO/LOW RISK AND WAIVER OF LIABILITY AGREEMENT
ACKNOWLEDGEMENT
I understand that the World Health Organization has classified the COVID-19 outbreak as a pandemic. I further understand that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes COVID-19 may result in significant personal injury or death. Both parties acknowledge the potential COVID-19 infection risks involved in incidental or more extended contact, and parties are fully aware that participation in the Services (including any related travel) carries with its certain inherent risks related to COVID-19 transmission (“Inherent Risks”) that cannot be eliminated regardless of the care taken to avoid such risks. Inherent Risks may include, but are not limited to, (1) the risk of coming into close contact with individuals or objects that may be carrying COVID-19; (2) the risk of transmitting or contracting COVID-19, directly or indirectly, to or from other individuals; and (3) injuries and complications ranging in severity from minor to catastrophic, including death, resulting directly or indirectly from COVID-19 or the treatment thereof. Further, parties understand that the risks of COVID-19 are not fully understood, and that contact with, or transmission of, COVID-19 may result in risks including but not limited to loss, personal injury, sickness, death, damage, and expense, the exact nature of which are not currently ascertainable, and all of which are to be considered Inherent Risks.
ASSUMPTION OF RISKS
By registering to a service provided by Drawwing Cabinet, you acknowledge to have read, and understand the above warning concerning COVID-19, and that you have undertaken reasonable steps to lessen the risk of transmission of COVID-19 in connection with the services under this agreement. Also, you agree to adhere to all applicable health and safety requirements, including the wearing of masks, washing of hands after contact, and maintenance of social distancing.
RELEASE AND WAIVER
In consideration of dispensing services that includes classes, workshops, events, and other gatherings (the “Services”), Drawwing Cabinet and customer (the “Parties), do hereby accept the risk of contracting COVID-19 for themselves and on behalf of their family, in order to utilize the Independent Contractor’s Services.
